These Terms of Service ("Terms") govern your access to and use of CarDiag AI Pro ("we," "our," or "us"), including our mobile applications, desktop applications, web services, and any related tools and features (collectively, the "Service"). Please read these Terms carefully before using the Service.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you:

  • Are at least 13 years of age (or the minimum age required in your jurisdiction)
  • Have the legal capacity to enter into a binding agreement
  • Will use the Service in compliance with all applicable laws and regulations
  • Have read and understood our Privacy Policy, which is incorporated into these Terms by reference

2. Account Registration and Responsibilities

2.1 Account Creation

To access most features of the Service, you must create an account by providing a valid email address and password. You must verify your email address to fully activate your account.

2.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Using a strong password (minimum 8 characters with mixed case, numbers, and symbols)

2.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to keep your account information updated. We reserve the right to suspend or terminate accounts that contain inaccurate or misleading information.

3. Subscription Tiers and Billing

3.1 Subscription Plans

The Service offers three subscription tiers:

  • Free — Basic vehicle diagnostics and maintenance tracking with advertisement support. Free users can earn Smart credits by watching rewarded advertisements to access Smart Analysis features.
  • Premium — Includes Smart Assistant, advanced analytics, expanded vehicle limits, Smart Diagnostics, and an ad-free experience.
  • Pro — All Premium features plus community features, priority support, higher vehicle limits, and an ad-free experience.

Feature availability and vehicle limits per tier are subject to change. Current limits and features are displayed within the application and on our pricing page.

3.2 Payment Methods

Depending on your platform, payments are processed through:

  • Apple In-App Purchase — for iOS users, managed through your Apple ID account
  • Google Play In-App Purchase — for Android users, managed through your Google Play account
  • Stripe — for desktop application users (Windows, macOS, Linux), processed via secure Stripe Checkout

All prices are displayed in the local currency of the applicable app store or payment provider. Taxes may apply based on your jurisdiction.

3.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless you cancel before the renewal date. By subscribing, you authorize recurring charges at the then-current subscription rate.

  • Apple — auto-renewal can be managed in your Apple ID account settings
  • Google — auto-renewal can be managed in Google Play subscription settings
  • Stripe — auto-renewal can be managed via the Customer Portal accessible from the application

3.4 Cancellation

You may cancel your subscription at any time. Upon cancellation:

  • You will retain access to your paid tier features until the end of the current billing period
  • Your account will be downgraded to the Free tier at the end of the billing period
  • No partial refunds will be issued for unused portions of a billing period

3.5 Refund Policy

Refund policies are governed by the respective payment platform:

  • Apple — refund requests must be submitted through Apple's support at reportaproblem.apple.com
  • Google — refund requests must be submitted through Google Play support
  • Stripe — refund requests can be submitted by contacting our support team. Refunds are processed at our discretion within 14 days of the original purchase.

If a refund is processed, your subscription will be immediately terminated, and your account will be downgraded to the Free tier.

3.6 Grace Period

If a renewal payment fails, a grace period of up to 16 days may be provided during which you retain access to your paid features while the payment issue is resolved. If payment is not recovered within the grace period, your account will be downgraded to the Free tier.

4. Acceptable Use Policy

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to our systems, other users' accounts, or data
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers) to access or interact with the Service without our written permission
  • Circumvent, disable, or interfere with security features of the Service
  • Submit false vehicle data, fabricated diagnostic codes, or misleading information
  • Abuse the rewarded advertisement system (e.g., using automated tools to watch ads)
  • Attempt to manipulate in-app purchase receipts or subscription status
  • Share your account credentials with others or allow multiple individuals to use a single account
  • Use the Service to harass, threaten, or harm other users

We reserve the right to suspend or terminate your account for violations of this Acceptable Use Policy.

5. Vehicle Diagnostic Disclaimer

Important: The Service is not a substitute for professional vehicle inspection or repair.

  • OBD-II diagnostic readings provided by the Service are for informational and reference purposes only.
  • Diagnostic trouble code (DTC) interpretations are based on standardized definitions and may not reflect the specific condition of your vehicle.
  • Always consult a qualified, certified mechanic or automotive professional before making repair decisions based on diagnostic data.
  • We are not responsible for any vehicle damage, personal injury, or financial loss resulting from reliance on diagnostic information provided by the Service.
  • The Service does not perform physical vehicle inspections and cannot detect all potential vehicle issues.

6. Smart Analysis Disclaimer

Smart Analysis features are powered by third-party analysis engines and are provided for informational purposes only.

  • Smart Analysis, Smart Assistant, and Smart Diagnostics provide suggestions and insights that may not be accurate, complete, or applicable to your specific situation.
  • Analysis results are generated by automated systems and should always be verified by a qualified professional.
  • We do not guarantee the accuracy, reliability, or availability of Smart Analysis features.
  • Analysis engine providers may change, which could affect the quality or style of responses.
  • Smart Analysis features may be temporarily unavailable due to provider outages or rate limits.
  • Do not rely solely on Smart Analysis for critical decisions regarding vehicle safety or repair.

7. Intellectual Property

7.1 Our Property

The Service, including its design, features, content, software, logos, and trademarks, is owned by CarDiag AI Pro and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

7.2 Your Content

You retain ownership of the data you submit to the Service (vehicle data, maintenance records, trip logs, etc.). By using the Service, you grant us a limited, non-exclusive license to use, process, and store your data solely for the purpose of providing and improving the Service.

7.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us an unrestricted, irrevocable, non-exclusive, royalty-free right to use such feedback for any purpose without compensation to you.

8. Advertisements

Free-tier users will be shown advertisements, including banner ads, interstitial ads, and rewarded video ads. By using the free tier, you agree to:

  • The display of advertisements within the application
  • Interaction data being shared with advertising partners in accordance with our Privacy Policy
  • Daily limits on rewarded advertisements as configured by our administrators

Premium and Pro subscribers are never shown advertisements. Smart credits earned through rewarded ads are non-transferable and have no monetary value.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
  • In no event shall CarDiag AI Pro, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill.
  • Our total aggregate liability for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
  • We are not liable for any damage to your vehicle, personal injury, or financial loss arising from the use of diagnostic information, Smart Analysis recommendations, or any other data provided by the Service.

10. Indemnification

You agree to indemnify, defend, and hold harmless CarDiag AI Pro and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

11.1 Termination by You

You may terminate your account at any time by using the account deletion feature within the application. Upon termination, your data will be handled as described in our Privacy Policy.

11.2 Termination by Us

We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms or the Acceptable Use Policy
  • Fraudulent or illegal activity
  • Non-payment of subscription fees
  • Extended period of inactivity
  • At our sole discretion if we discontinue the Service

11.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will continue to apply.

12. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance and updates
  • Server or infrastructure issues
  • Third-party service outages (analysis engines, payment processors, app stores)
  • Force majeure events

The desktop application requires an active internet connection to function. Features are not available offline.

13. Modifications to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. For material changes, we will provide notice through the application or via email.

Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and delete your account.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be resolved through:

  1. Informal negotiation — the parties shall first attempt to resolve the dispute through good-faith negotiation for a period of 30 days
  2. Mediation — if negotiation fails, the parties agree to attempt mediation before a mutually agreed-upon mediator
  3. Binding arbitration — if mediation fails, the dispute shall be resolved through binding arbitration in accordance with applicable arbitration rules

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, class arbitration, or any other representative proceeding.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CarDiag AI Pro regarding your use of the Service. These Terms supersede any prior agreements, communications, or understandings, whether written or oral, relating to the Service.
